Terms of use
The rules for using this website and our service, in plain English.
Effective October 23, 2026
These terms are an agreement between you and Fusion Tactix LLC ("Fusion Tactix", "we", "us"). They cover this website and our managed website service: building, hosting, changing and supporting your website (the "Service"). By using this site or the Service, you agree to them. If you use the Service for a business, you agree for that business and confirm you're allowed to. If you don't agree, please don't use the site or the Service.
If you sign a separate client agreement or order form with us, it wins where it differs from these terms. Our privacy policy explains how we handle personal information.
Who can use the Service
You must be at least 18 and able to enter a contract. The Service is for businesses and professionals in the United States. You agree to give us true, current information and to keep your logins safe. You're responsible for what happens under your account and in your client chat.
What we do
We build your website, host it, keep it secure and backed up, and make the changes you ask for through your chat. Normal small changes are included in your plan. Bigger work, like a redesign or a new feature, gets a flat quote first, and we'll only start once you say yes. What each plan includes is shown on our pricing page when you sign up.
We may improve, change or stop parts of the Service over time. If we remove something important from your plan, we'll tell you first.
AI changes and your approval
Our team uses AI tools to make changes faster. The AI works inside our rules, and a person on our team reviews bigger changes. AI can still get things wrong, so:
- Please check each change. When you approve a change, or ask us to publish it, you're confirming it's correct and that you're happy for it to be live.
- You're responsible for the facts on your site: prices, hours, claims, licenses, offers and anything else about your business.
- If something looks wrong, tell us in your chat and we'll fix it or roll it back.
Your content and your business
You own the content you give us: your words, photos, logos, videos and business information ("Your Content"). You let us copy, store, edit, display and publish Your Content only as needed to run the Service and your website. You can also let us show your site as an example of our work; we'll only do that with your permission.
You're responsible and liable for Your Content and for your business. That means you promise that:
- You have the rights to everything you give us, including photos, music, fonts and logos.
- Your Content and your website are true, not misleading, and follow the laws that apply to you, including advertising, consumer, licensing, privacy and accessibility rules for your industry.
- You have any licenses or permits your business needs.
- You'll handle your own customers, orders, refunds, bookings and disputes.
We don't check every word, and we're not your lawyer, accountant or compliance advisor.
What's not allowed
You may not use this site or the Service, or ask us to build or change anything, that:
- Breaks any law, or helps someone else break one.
- Sells, promotes or arranges illegal drugs or drug paraphernalia, or legal drugs (including cannabis and prescription drugs) where that isn't legal or needs a license.
- Sells alcohol, tobacco, vaping products, firearms, ammunition or other weapons in a way that breaks the law, skips age checks, or needs licenses or features we don't support.
- Shows or links to pornography, nudity or other adult or sexual content of any kind.
- Promotes hate or violence against people because of who they are, or threatens, harasses, bullies or stalks anyone.
- Is false, defamatory, or deceptive, including fake reviews, fake testimonials, made up credentials or awards, or scams.
- Infringes anyone's copyright, trademark, privacy or other rights.
- Spreads malware, phishing pages or harmful code, or tries to break into, overload, scrape or get around the security of our systems or anyone else's.
- Sends spam or unwanted messages, or collects people's information without the notice or consent the law requires.
- Involves gambling, high risk financial schemes, or anything else that needs a license you don't have.
- Puts children at risk in any way.
If you're not sure whether something is allowed, ask us first.
Our right to remove content or suspend a site
We may refuse a request, remove or disable content, or suspend or end your website or account if we reasonably believe you've broken these terms, the law, or our payment terms, or if something puts people, our systems or other clients at risk. When we can, we'll tell you first and give you a chance to fix it. When the risk is serious or the law requires it, we may act right away. If we end the Service because you broke these terms, you won't get a refund.
Plans and billing
- Monthly plans are month to month. There's no long contract. They renew automatically each month until you cancel.
- Yearly plans are paid up front for 12 months at a discount. Because of the discount, yearly payments are not refundable, in whole or in part, unless the law requires it. Yearly plans renew automatically for another year unless you cancel before the renewal date. We'll remind you before a yearly renewal.
- One time fees, like a setup fee or a quoted project, are shown before you pay and are not refundable once the work has started.
- Price changes: we'll give you at least 30 days' notice before a price change affects you. A new price for a yearly plan starts at your next renewal.
- Taxes: prices don't include sales tax or similar taxes, which we'll add where required.
- Late payments: if a payment fails, we'll let you know and try again. If it's still unpaid after a reasonable time, we may pause your website until it's paid.
- Payments are handled by our payment processor (Stripe). By paying, you also agree to its terms.
Cancelling
You can cancel any time by telling us in your chat or by email. Cancelling stops future charges. Your plan stays active until the end of the period you've already paid for, and we don't give partial refunds for unused time. We don't charge a fee to cancel.
Final terms being set. We're finishing the details of what happens to your website after you cancel, including how long we keep your files and what you can take with you. Until they're posted here, we'll explain them in writing before you sign up, and we'll always give you a copy of Your Content if you ask before your plan ends.
Domain names
- A domain you already own stays yours. If you move it to us or point it at our hosting, you keep ownership, and you can move it away again at any time.
- A domain we register for you is registered through a domain registrar and is subject to that registrar's rules and to ICANN rules, including a 60 day lock on transfers after a new registration or transfer. Final terms being set: who is listed as the owner, and what it costs to take the domain with you if you leave, will be posted here. Until then, we'll explain them in writing before we buy a domain for you.
- You're responsible for making sure a domain name doesn't infringe anyone's trademark.
- If your plan ends and a domain isn't renewed, it may expire and could be registered by someone else.
Our property
This website, our brand, and the tools, code, templates, design system, rules and processes we use to run the Service belong to Fusion Tactix. Using the Service doesn't give you ownership of them. The words, illustrations and design on this site are ours too; please don't copy them. The sample designs shown here are made up and are not real businesses. Client websites shown on this site belong to those businesses.
If you send us ideas or suggestions, we can use them without owing you anything.
Other companies' services
The Service can connect to other companies' tools, like booking, payment, email or CRM software, and this site links to others, like Calendly. Those services have their own terms and prices, and we're not responsible for them, their outages or their changes. You're responsible for your accounts with them.
No guarantees
We work hard to keep your site fast, online and secure, and we keep backups. But the Service and this site are provided "as is" and "as available". As far as the law allows, we don't promise they'll always be available, error free or secure, or that they'll bring you a certain number of visitors, leads, rankings or sales. We make no other warranties, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limits on our liability
As far as the law allows:
- We're not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, customers or goodwill, even if we were told they might happen.
- Our total liability for any claim about this site or the Service is limited to the amount you paid us in the 12 months before the claim, or $100 if you haven't paid us anything.
Some states don't allow some of these limits, so they may not all apply to you.
If someone makes a claim because of your content or business
You agree to defend and pay for (indemnify) Fusion Tactix, its owners and its team against any claims, losses, fines and costs (including reasonable lawyer fees) that come from Your Content, your website, your business, your products or services, or your breaking these terms or the law. We'll tell you about the claim and can take part with our own lawyer.
Copyright complaints
If you believe something on a site we host infringes your copyright, email us at tyler@fusiontactix.com with: your contact details, what work you think was copied, where it appears (the web address), a statement that you believe in good faith the use isn't allowed, a statement that your notice is accurate and that you own the rights or are allowed to act for the owner, and your signature. We'll look into it and may remove the material.
If these terms end
The sections on billing already owed, Your Content responsibilities, our property, no guarantees, limits on liability, indemnity and governing law keep applying after you stop using the Service.
Changes to these terms
We may update these terms as the Service grows. We'll post the new version here with a new effective date, and tell clients about important changes at least 30 days before they take effect. If you keep using the Service after that, you accept the new terms. If you don't, you can cancel.
Governing law and disputes
These terms are governed by the laws of the State of Utah and of the United States, without regard to conflict of law rules. Please talk to us first: most problems can be sorted out with a conversation. If we can't work it out, any lawsuit must be brought in the state or federal courts located in Salt Lake County, Utah, and you and we agree to those courts. Either side can still use small claims court for a claim that qualifies.
The rest
- These terms, our privacy policy and any client agreement are the whole agreement between us about the Service.
- If part of these terms can't be enforced, the rest still applies.
- If we don't enforce a rule right away, we can still enforce it later.
- You can't transfer these terms to someone else without our OK. We can transfer them if Fusion Tactix is sold or merges.
- We're not responsible for delays caused by things outside our control, like outages at our providers, natural disasters or internet failures.
